Terms of Service
These Terms of Service govern all purchases and interactions between the customer (“Purchaser”) and Tarpon SF LLC. (“Tarpon Stainless”) through quotes, correspondence, or via the official website at www.tarponstainless.com.
Orders
All orders resulting from our published pricing, formal quotes, or proposals are subject to acceptance by Tarpon Stainless. Production will not begin until Tarpon Stainless has established credit terms with the Purchaser and received the following:
- Signed purchase order
- Signed and approved drawings (if applicable)
- Signed production release form
Changes
Any changes made by the Purchaser after fabrication has begun must be submitted in writing. Purchaser agrees to pay any additional costs associated with such changes, including materials, labor, and administrative adjustments.
Claims
Title and risk of loss transfer to the Purchaser upon delivery to the carrier, unless otherwise specified in writing. Any damages or shortages must be noted on the bill of lading at the time of delivery. Tarpon Stainless is not responsible for damage during transit.
Codes and Regulations
Tarpon Stainless is not responsible for any additional costs or modifications required for products to meet federal, state, or local building codes, health standards, or regulatory compliance unless specifically agreed to in writing at the time of order.
Restocking and Cancellation Policies
Orders canceled or modified by the Purchaser after release for production may be subject to a restocking or cancellation fee of up to 30% of the total order value, or full invoiced value depending on the stage of fabrication. Custom or made-to-order products are non-returnable and non-refundable.
Product Usage Disclaimer
All products supplied by Tarpon Stainless are intended for their specified industrial or commercial use only. It is the Purchaser’s responsibility to ensure proper application, handling, and installation. Tarpon Stainless is not liable for issues arising from misuse or improper installation by third parties.
Limitation of Liability
Tarpon Stainless shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products. In any event, Tarpon Stainless’s liability shall be limited to the amount paid by the Purchaser for the specific product giving rise to the claim.
